Bolaoo Terms of Service & User Agreement

Welcome to Bolaoo. By downloading, registering, or using the Bolaoo app or any of our services, you agree to be legally bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree, you must not use our services.

1. About Bolaoo

Bolaoo is a technology platform that connects passengers ("Riders") with independent driver-partners ("Drivers") for on-demand ride-hailing services in Nepal. Bolaoo does not provide transportation services directly; it facilitates connections between Riders and Drivers through its mobile application and related technology.

2. Eligibility

• You must be at least 18 years of age to create an account or use our services.
• You must have the legal capacity to enter into a binding contract under the laws of Nepal.
• Drivers must hold a valid driving licence, vehicle registration, and all permits required by applicable Nepali law.
• You may not create an account on behalf of another person without their express consent.

3. Account Registration & Security

• You must provide accurate, complete, and up-to-date information during registration.
• You are solely responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately at [email protected] if you suspect any unauthorised access to your account.
• Bolaoo will not be liable for any loss or damage arising from your failure to keep your credentials secure.
• One person may hold only one active account. Duplicate accounts may be suspended.

4. The Bolaoo Platform

Bolaoo provides a marketplace that enables Riders to request rides and Drivers to accept them. Bolaoo is not a transportation carrier. The contractual relationship for the transportation service is between the Rider and the Driver. Bolaoo acts solely as a technology intermediary and is not responsible for the acts or omissions of any Driver or Rider.

5. Booking & Ride Conduct

• Ride requests are matched to available Drivers based on proximity and other factors.
• Riders must be at the pickup location within a reasonable time after a Driver arrives.
• Riders and Drivers must treat each other with respect. Harassment, discrimination, or abuse of any kind is strictly prohibited and may result in permanent account suspension.
• Riders must not ask Drivers to violate traffic laws, speed limits, or other regulations.
• Animals (other than certified service animals), open food and beverages, and hazardous materials are not permitted in vehicles unless agreed upon with the Driver.
• Seat belts must be worn by all occupants at all times during a ride.

6. Fares, Payments & Receipts

• Fares are calculated based on base rate, distance, time, and applicable surge or demand pricing.
• The estimated fare shown before booking is an approximation. Final fare may differ due to route changes, traffic, or waiting time.
• Payment is processed via the in-app payment methods available in your region (cash, digital wallets, or card where supported).
• Receipts are available in-app after each completed ride.
• Bolaoo reserves the right to adjust fares in cases of significant route deviation or extraordinary circumstances.
• In the event of a pricing error, Bolaoo may void or correct the transaction and will notify you.

7. Cancellations & No-Shows

• Riders may cancel a ride request free of charge before a Driver has been assigned.
• Cancellations made after a Driver has accepted the request may attract a cancellation fee, which will be disclosed in the app at the time of cancellation.
• If a Rider is not present at the pickup location within the waiting period shown in the app, the Driver may cancel and a no-show fee may apply.
• Repeated cancellations or no-shows may result in temporary or permanent account restrictions.

8. Driver Terms

• Drivers are independent contractors, not employees, agents, or partners of Bolaoo.
• Drivers are responsible for maintaining a roadworthy, insured, and legally compliant vehicle at all times.
• Drivers must have valid vehicle insurance covering passenger liability.
• Drivers must complete Bolaoo's onboarding verification before going online.
• Drivers must follow all applicable traffic laws, speed limits, and road safety regulations.
• Drivers must not drive under the influence of alcohol, drugs, or any substance that impairs their ability to operate a vehicle.
• Drivers must maintain a minimum rating as required by Bolaoo's quality standards; failure to do so may result in suspension.

9. Ratings & Reviews

Both Riders and Drivers may rate each other after a completed trip. Ratings are used to maintain service quality and safety standards. Manipulating ratings (e.g., incentivising others to leave positive or negative reviews) is prohibited and may lead to account suspension.

10. Safety & Emergency Features

• Bolaoo provides in-app safety features including live trip sharing and an SOS/emergency button. These features are provided on a best-effort basis and do not guarantee emergency response.
• In the event of an emergency, always contact Nepal Police (100) or ambulance services (102) first.
• Misuse of the SOS or emergency feature (e.g., false alerts) is a serious violation and may result in permanent account suspension and legal action.

11. Prohibited Uses

You agree not to:

• Use the service for any unlawful purpose or in violation of any local, national, or international law.
• Solicit personal contact information from Drivers or Riders for purposes outside the platform.
• Reverse-engineer, decompile, or tamper with any part of the Bolaoo application.
• Use automated tools (bots, scrapers, etc.) to access or interact with the platform.
• Impersonate another person or entity.
• Resell or commercially exploit the service without Bolaoo's written consent.
• Use the platform to transport goods for commercial purposes unless expressly permitted.

12. Intellectual Property

The Bolaoo name, logo, app design, and all content therein are the exclusive intellectual property of Bolaoo and its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the app solely for personal, non-commercial purposes. No other licence is granted.

13. Privacy & Data

Your use of Bolaoo is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your data as described therein.

14. Disclaimer of Warranties

The Bolaoo platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or uninterrupted availability. Bolaoo does not warrant that the app will be error-free or free from viruses or other harmful components.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Bolaoo and its directors, employees, and agents shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from:

• Your use of or inability to use the service.
• Any conduct or content of any Driver, Rider, or third party on the platform.
• Unauthorised access to or alteration of your data.
• Any interruption, suspension, or termination of the service.

Bolaoo's total aggregate liability to you for any claim shall not exceed the amount you paid for the specific ride giving rise to the claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless Bolaoo, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the service, your violation of these Terms, or your violation of any rights of a third party.

17. Termination & Suspension

• You may delete your account at any time via the app's Settings > Delete Account option or via our Delete Account page.
• Bolaoo may suspend or terminate your account at any time, with or without notice, if you violate these Terms, pose a safety risk, or engage in fraudulent activity. Suspended users may appeal via our Appeals page.
• Upon termination, your right to use the service ceases immediately. Clauses that by their nature should survive termination (including Sections 12, 14, 15, 16, and 18) will remain in effect.

18. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Nepal. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts of Kathmandu, Nepal.

19. Changes to These Terms

Bolaoo reserves the right to update or modify these Terms at any time. We will notify you of material changes via the app or by email. Your continued use of the service after the effective date of any changes constitutes your acceptance of the revised Terms.
